The Fhoto by Shaun hereinafter would be termed as the COMPANY and the person undertaking responsibility of services, deliverables, payment and/or event planning SPOC would henceforth be referenced as the
CLIENT.RESERVATION:
A signed contract and retainer fee are required to reserve the dates and times of the EVENT(S). If the EVENT(S) are rescheduled, postponed, or canceled; or if there is a breach of contract by the CLIENT, the retainer fee is non-refundable and shall be liquidated damages to The COMPANY. The CLIENT shall also be responsible for payment for any of the COMPANY’s materials charges incurred up to the time of cancellation.
EVENT SCHEDULE:
The client agrees to confirm the schedule three weeks prior to the EVENT(S). Notification of any changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from The COMPANY by the CLIENT.

The COMPANY reserves to right to terminate coverage and leave the location of the EVENT(S) if the photographer from the COMPANY experiences inappropriate, threatening, hostile, or offensive behaviour from person(s) at the EVENT(S); or in the event that the safety of the photographer from the COMPANY is in question. COMPANY will provide the data available to the CLIENT and charges/fee will be non-refundable.

The CLIENT and the COMPANY agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If the CLIENT does not arrive at the appointed time for the EVENT(S), shooting time will commence at the scheduled start time and end at the scheduled end time. All additional time beyond the scheduled end time will be billed to the CLIENT on a pro-rata basis for the individual services consumed/utilised.

Please discuss with us whether you would like to opt for reimbursing expense, so that Company can make its own arrangements and claim based on bills or if the Client would arrange the necessary travel.

The COMPANY is not responsible for backgrounds or lighting conditions that may negatively impact or restrict the photo coverage. The COMPANY is not held liable for missed coverage of any part of the EVENT(S) due to the above-mentioned reasons. The COMPANY will not be held accountable for failure to deliver images of any individuals or any objects at the EVENT(S).

The COMPANY is limited by the rules and guidelines of the location(s) and site management. The CLIENT agrees to accept the technical results of their imposition on the COMPANY. Negotiation with the officials for moderation of guidelines is the CLIENT’s responsibility; the COMPANY will offer technical recommendations only.

The CLIENT is responsible for acquiring all permits and necessary permission for all locations on which the COMPANY will be performing services, including permission from the nearest police station for flying drones if the service opted.

MODEL RELEASE & COPYRIGHTS:
The CLIENT hereby assigns the COMPANY the irrevocable right to use and publish select photographs taken at the event in which the CLIENT/COUPLE may be included, for the COMPANY’s trade, advertising, and promotional use and to alter the same without restriction; and to copyright the same without restriction. (OR) claim copyrights of all images and restrict usage of images in social media by paying 10% of the total invoice amount on the last day of the event. We can assure that Client’s privacy concerns will be considered in case if we are requested to not publish certain intimate/romantic posed images of the couple.

In the unlikely event that the assigned photographer from the COMPANY is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of the COMPANY, the COMPANY will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the EVENT(S). We as a team are proud to confirm that the later circumstances have not been faced by any of our clients in our 5 years of service.In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the COMPANY’s control, including but not limited to camera, hard drive, or equipment malfunction, the COMPANY liability is limited to the return of all payments received for the EVENT(S). The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of a total number of originals. COMPANY will not be responsible for any loss of files, photographs, and video, beyond 60 days after the last shoot. CLIENT is expected to collect the data within 35 working days of the last EVENT and provide an external HDD to the COMPANY to store the respective data.

If suggestions are not received within a week of the wedding, we will proceed with the best suitable bg music/song and further changes will incur additional editing charges.

Our mini sessions and just born are more often done indoors at our studio. We do travel to your location at an extra charge. In such scenarios, the theme and props will be preplanned and we will have little scope for experimentation at your location. So we highly recommend utilizing our flexibility at our studio space.How soon should I have my newborn session after giving birth?The sooner the better! Newborns tend to stay sound asleep a few days after birth and because of this, we are able to gently move your little one into sweet poses.
After a couple of weeks, this is not as easy to do. After the 14-day mark, babies begin to stretch and the poses won’t be as easy to accomplish.How do we get our photos?You will receive them on a digital gallery ready for you to share & download instantly. You also have the option to order with us – printed images, albums, or magazine books and photo frames, which I would highly recommend – it’s so easy to forget about our photos when they’re in your hard drives and digital repository.
